Many companies have DVR inventions, TiVo's is one of them, and E*'s old DVRs infringed that particular TiVo's DVR invention.
TiVo's hardware patent [claims] were not thrown out, the appeals court had found that the E*'s DVRs did not literally infringe on TiVo's hardware claims, but the appeals court also said whether they had infringed on the hardware claims by the "equivalents" standards was up to TiVo to decide if they wanted to continue to pursue it at the lower court's level.
TiVo subsequently decided not to pursue the hardware claims infringement by equivalents standards, rather only to go after the software claims.
BTW there is no "hardware patent" or "software patent", only one patent, and this patent consists the hardware claims, and the software claims.
But TiVo suffers no conseqences because both TiVo and RePlayTV settled. It is true that the reason ReplayTV settled with TiVo was because ReplayTV had no resources to go after TiVo in the court, and TiVo was suing ReplayTV for infringement as well.
You can certainly infringe, as long as the patent owner allows you to infringe.

It is your opinion, I have never read anyone else, not even TiVo said TiVo invented E*'s DVRs. I'd rather read what TiVo is saying, or what E* is saying, and even much more importantly, what the Court is saying.
The Court said E*'s old 8 named DVRs infringed on the TiVo's patent.
In denying TiVo's treble and attorney fees, Judge Folsom said E* had started to develope its own DVRs years before TiVo even existed as a comany, therefore TiVo could not claim this infringement was a "copying" case.
