How can you get banned in the War Zone? What did you do? Lots of swearing? :confused:

No swearing...

I'd like to think that I willingly sacrificed my membership in order to get the "whats cooking" forum on this board....

But in reality, I think someone just didn't like me...:eek:
 
I hate to sound this way, but let's not try so hard to get this thread moved to the WZ. If the mods do not like the tone, feel free to remove some of the posts, including mine if they are offensive, before considering just move it over to the WZ.

The reason I hate to sound this way is because, what I am suggesting is actually what the other site does so good at, just much too good at it, as Scott alluded to earlier:)

Not planning on moving this, but about had it with the bickering. Its like herding cats with a few of the guys. So, back on topic. Last word on it.
 
Back to the topic.

I have recently said a few things about this new DE case:

1) E* must try very hard to convince the DE judge not to transfer the case to the TX court.
2) If E* was found in contempt by the TX court, this new case would be the last thing E* would worry about.
3) The DE judge should wait till Judge Folsom makes his contempt decision before deciding if he would transfer this case or not.

Now E*'s filing is out, and E* said pretty much the same things.

E* argued hard to keep this case in the DE court, but other points are more telling.

1) This new case was filed to prevent TiVo from filing a similar new case, in the event Judge Folsom finds E* not in contempt.
2) E* also suggested the DE judge wait till Judge Folsom first makes his ruling.

E* seems confident their new design is successful, and they should be.

Let's see what TiVo's response will be.
 
Another thing to note, I also said one of the unlikely but possible argument by E* could be Judge Folsom's apparent anger over E*'s filing of the new case without telling him first.

While E* predictably did not try that one, E* did make a point of the TX court being a hotbed for patent infringement cases, so much so that a new case may take three years just to get started.

The TX court used to be patent trolls' choice of jurisdiction because the local population seemed to favor patent owners, this was true back in 2006, until E* turned the tide, by defeating Forgent's patent suit against E*.
 
What I find Funny is EchoStar didn't even work with TIVO making DVRs, But yet perfected a Great DVR.
D* and Tivo were Partners,and look where that got them.
So why couldn't D* build a DVR with Tivo that wins awards?
I hate to say it But E* great DVRs, I doubt had much of any stolen Tivo knowledge.
