In no way am I excusing what Donte did or the lax penalty he received, but I'm guessing the soft penalty was because it was difficult for the prosecution to prove that this accident would not have happened had Donte not been slightly impaired. Also, the victim was jaywalking on a stretch of 50mph road, which throws another wrench into the equation.
This is a case of intent vs. cause. Did Stallworth intend on killing someone? Probably not. Did his BAC of .126 cause him to run over a guy that was jaywalking? Maybe, maybe not. It's a tough case for a court to decide.
With that said, I do like the 1,000 hours of community service he got. Whether you want to see Stallworth punished by sitting in jail is one thing, but what does that really do besides make the victim's family feel better? I appreciate that his efforts will be going to community service which may help aid in improving some areas of life.
Sad situation for all parties involved.
