He will more than likely do time. This agreement only stops the CIVIL lawsuit from coming, he still has to face state cherges.

Oh, I know. This just settles the civil suit. Stallworth is expected to give his official guilty plea in front of the courts this afternoon. A jail sentence will most certainly follow...
 
There's a state law that in the case of DUI manslaughter convictions you do a minimum 4 year (or automatic 4 year, not sure) sentence. Because he's pleading guilty, he won't be 'convicted', just sentenced. Without the Reyes family to contest the ruling (since they've been satisfied via settlement) he'll likely see much less time. That's if the court and everyone agrees this isn't the same as being convicted.

Breaking: Stallworth Sentenced to 30 Days in Jail, 10 Years Probation....

MIAMI -- Cleveland Browns wide receiver Donte' Stallworth is going to serve 30 days in jail after pleading guilty in Florida to a DUI manslaughter charge.

The plea deal announced Tuesday calls for the 28-year-old Stallworth to also serve 10 years' probation and do 1,000 community service hours for killing a pedestrian he hit with his car.

And to think...Michael Vick gets HOW MUCH??!! Yep....I wann see how of the Vick hater stick up for THIS BS vacation that Stallworth got. He could have done the 10 years probation in his sleep!

Every single scumbag that has money will line up for his lawyers service.

Not that it makes it any better, but I just heard on the local radio that Stallworth will also face 2 years of house-arrest to be tacked onto his 30-day jail sentence.

They then went onto clarify that Stallworth would be allowed to work while under house arrest if allowed by the NFL.
 
In no way am I excusing what Donte did or the lax penalty he received, but I'm guessing the soft penalty was because it was difficult for the prosecution to prove that this accident would not have happened had Donte not been slightly impaired. Also, the victim was jaywalking on a stretch of 50mph road, which throws another wrench into the equation.

This is a case of intent vs. cause. Did Stallworth intend on killing someone? Probably not. Did his BAC of .126 cause him to run over a guy that was jaywalking? Maybe, maybe not. It's a tough case for a court to decide.

With that said, I do like the 1,000 hours of community service he got. Whether you want to see Stallworth punished by sitting in jail is one thing, but what does that really do besides make the victim's family feel better? I appreciate that his efforts will be going to community service which may help aid in improving some areas of life.

Sad situation for all parties involved. :(

It sickens me that this jerk gets off by paying hush money and walks after a month for killing someone while knowingly impaired behind thw wheel!

I don't know, id rather do prison for a couple years and be able to drive again. Though I'll never have the money to be chauffeured the rest of my life either. For someone with no history, and completely cooperating, this is starting to look a little harsh, heh. For him though, staying out of prison means he can still possibly play football and enjoy a multimillion dollar annual income.

Let me get this straight....you being a millionaire and sitting in your own home, sleeping in your own bed and seeing your friends and family WHENEVER you want.....would rather do time in jail just because you had your drivers license taken away?!! Seriously??!! :what:what:yikes:yikes

Unfortunately it doesn't seem like Stallworth's net worth was a factor in the prosecutor's intentions. You hear way too often about people getting what those of us outside the legal system would term light sentences...not just millionaires.
