Even though the under eave mount would be a great solution, if the op needs a k.4 dish, most mounts offered by Dish are not approved for use with the 1000.4. They do now have a facia mount plate that just came out recently that is approved. I know it seems rather silly to have all different mounting options and by DNS code, can't use them.

Sorry for not posting soon enough I was away in a trip, here is my follow up I decided to go ahead with the install went very well but guess what I guess a nosy neighbor decided to report to the hoa and of course I got a letter of violation for installing on my roof. From the purchasing documents I have from my place is warranty deed and PUD rider there is probably more but I have to look for them. The Pud rider says that the property I bought includes but i's not limited to, a parcel of land improved with dwelling, together with other such parcels and certain common areas and facilities described in the covenants, conditions and restrictions. The warranty deed says that seller give me(the grantee) the following homesite with a certain piece or parcel of real property located where I am right now(sorry for not saying complete address), together with interest in the appurtenant allocated interest. From my understanding I do own the land underneath. My property consist of a 2 level townhome with underneath garage, 2 level kitchen, dining room, and livingroom and upstairs bedrooms so as you see all I have on top of the bedrooms is the roof I could see the inside of the roof thru a small attic door in my bedroom. I do not have no one on top of or below my townhome just ajoined thru the sides. I wish I would had done my homework before buying here but these bastards suck you into buying this beautiful homes that the only thing you think is buying and moving in. I read the otard rules and I believe it applies to me they can't force me to take down my dish. I receive the letter thursday and I am going to fight this. I bet they don't send one to that other person who has have it on top of his roof for the past 3 years. I am going to reply to them tuesday telling them that they are not in compliance with FCC rules and probably send them a copy of rules and if not I am going to file a petition with FCC. what do you guys think
 
You need to read the declaration. If the roof isn't defined as a limited common area you may not have a leg to stand on. The roof is usually considered a common area.

If they fine you X$$ per day until you comply the association will eventually get their money when you sell the property as they will file a lien.

Tell them you'll forward a complaint to the FCC since you believe they are trying to interfere with your enjoyment of satellite, but don't send them your copy of OTARD, let them go look for it themselves.

I disagree with the "not sending" *IF* they are just sending to be a hassle ... or because some other neighbor is making them.. you send back a politely worded notice that you believe OTARD is for these situations, the installer had no other allowed options that you were aware of, and that no Dish approved options were presented by the managment ... which *should* in their best interest work on such options if they want want to curtail but not restrict use of dish ... that property management would find *Dish* approved alternative information to provide their town home clients.

*and* include a copy of otard ... so that they know you *have* researched and maybe they will let it drop, or know without asking that they'd have you put up a fight ... or if its the nosey neighbor situation.. the management can reply to nosey that you checked you were within your rights.. etc..


As for the smack on your hand ... you had MORE THAN fair warning about this.. regardless of who's right you now have to be preparred for the battle. Had you done your diligence.. and sought out the alternatives first ... you may have found something that would have fit perfectly and not caused any further issue to come up.. but now.. you're in it.. and you're going to have to dig yourself out of it.. again even if you're right.. you're going to have to continue to prove it if *they* decide to press this issue... even if they are wrong.. just by them pressing the issue... in so far as taking you to court.. you still lose some of your time (which is money) and will still have to fend off your actions against them (if you win in the courts I'm guessing you get compensation for legal fees.. but you've still got to take the time to find a lawyer, and most don't take cases like this for "if you win" contingencies)
 
The roof is Limited Common Property in all HOA, because if a new roof is required for the complex, then all roofs will get re-done at same time. I had similar problem many years ago with the former president of the HOA, I lived at, complaining about my dish and the size of my dog, eventually 1 day it lead to a physical confrontation, I stopped short of killing him (at my wife's begging me) the guy backed off complaining directly to me, but this didn't stop him from his letter writing campaign, (which got nowhere other than me receiving requests to take the dish down) then I got new neighbors on the townhouse next to me and they too started complaining about my dish, eventually, I had enough and sold my unit and bought into another place about 1/2 mile away, where I was able to put up a 1000.4 to go with my new 722k and point my original 500 dish to Canada Sats, now I have 2 dishes (I sub to both providers, wife is from Canada), I've had no issues with any neighbors or complaints from the HOA, in fact they even let me replace my brick and grass ground floor patio with concrete and allowed me to mount a proper pole to place my dishes on. I still see the old HOA Nazi around the neighborhood from time to time, but it's all calm, as I see him now as a man with nothing better to do in life than complain, it's just him and his old little dog that I found out had been attacked by a Shepherd, similar breed as my dog and this whole dish thing was just him trying to get revenge on the dog attack, but it wasn't my dog, this happened before we bought the first place. Anyhow I sold my unit for $80k more than I thought I could get for it, when the market was at it's peak, and glad I got out of there when I did. I'm so happy at my current place awesome people, But I also got smart, when there was a requirement for a new property management company to take over, Me and another owner who's got an HDTV and HAM antennas got together and we arranged for the new company to get the contract for this place, we went door to door and convinced a majority of owners here to approve of this new company's contract and we told them (Property Managers) not to mess with us 2 owners, otherwise we'll ensure their contract for this complex doesn't get renewed. Never had any issues. Wish you all the best of luck, sometimes these things happen for a reason.
 
This morning I was visiting a friend and my wife call me and told me that there is a latter on my home and someone is walking on the roof, she tought they were going to take the dish. I told her they better not before bigger problems arise but she told me they came down and then left. It was the hoa who sent someone to see how I had the dish installed
