Injunction against BD.

Interesting reading, but I doubt there will be an injunction. The patent is from 1993! Applied for in 1988, and she is just getting around to trying to enforce it? The Supreme Court last year pretty much said injunctions should not be the default action. The patent will be expiring soon, if she has not been fighting this for a while, perhaps they will consider it abandoned.

SHe's smart for waiting for something significant to sue, IMO. Not sure why they wouldnt consider it as long as she files suit before its expired.

This is her MO. She waits until somebody produces a viable product for the consumer -- then she sues --- then she settles out of court. She has done this a few times in the last 15 years. This will barely be a blip - if that in BD's march to consumer acceptance.

Philips and Nichia settled. So will the rest of the gang.
Unless someone wants to pull a RIM and settle for 10 times more at the eleventh hour...
Sony vs. Distinguished American Citizen doesn't have a chance in a US court.

Diogen.
