Dish Statement on Tivo PTO Action

Nor did I say that it can't be. but to even suggest that this is the reason for the dismissal is assinine.

Well, considering that Tivo is turning litigation into its only business model...

Indeed. Their new suits seems to tell me they are worried about losing their case with the PTO. Time to use all leverage to get some cash before they have nothing to go on. I would otherwise think they would wait until there was a nice, firm precedent setting decision in the Dish case that there was no design around.

Only problem it seems is that they have hit deep pocket co's but also these are all co's that have large law firms on retainer. Don't think going after 2 of the largest telco's was smart thing to do. On the ropes w/ E* right now and going after 2 telco's. What a really smart move. :eek:

DISH is the one on the ropes right now.
 
You'd think the last thing they would want is yet another patent examination.
 
Ah, just when it seemed like there was nothing else to deal with... the Tivo crap raises its ugly head again.

Gentlemen (and ladies), remember our rules on this topic. All discussion is related solely to the news that prompted this thread. Keep it on topic and do not turn it into the Tivo vs. Echostar endless drivel between both sides.

Very very slim chance that the patent gets invalidated. Even if it does, that is years away.

The DISH injunction appeal will be over long before then.

First, I don't think it is "years" away. Also, I don't think an injunction would last after the patent it is based on is invalidated.

Well, I keep my settings at 50 posts per page, so it just looks shorter for me:)
 
You don't think there will be appeals if the patent is invalidated?

If (and I mean if) the patent is invalidated, the Dish case would be put on hold until TiVo was done with its patent invalidation appeals. It is possible this could drag on until the end of the patent life.

Tivo shown its true colors as a patent troll looking to sue everyone under the sun while failing to innovate or DO ANYTHING with the product...

And the PTO is investigating it...

Greed and laziness does eventually get its just due...

I won't disagree, but Tivo's officers have a legal obligation to defend their intellectual property rights that were issued by the USPTO.

And the PTO is investigating it...
They've already investigated "it" when they issued the patent, and re-investigated "it" during the court procedings, and are now in the process of re-re-investigating "it" once again. I doubt the patent(s) will be overturned ~but~ if they are the decision will be long after Dish Network's contempt ruling is upheld and penalties are paid.

That may very well be, but right now it's due more than 200M by Dish Network, with another 300M getting ready to be tacked-on (my estimate).

In the long run, I think Verizon/AT&T will win their case with Tivo and the Tivo patents "may" very well be overturned a couple years from now. We shall see.

The Tivo Versus Dish Network case was big for Dish Network, but it also served to fuel Tivo to go after others who they perceive are stealing their IP. However, their case against verizon/AT&T is even bigger because, if successful, the ruling will give them momentum to go after all the Cable MSOs. Offhand, my "guess" is that Verizon/AT&T will come out on top, but if they broke the law they need to pay.

As far as VOOM versus EchoStar...big bucks involved in this one, and will be interesting to finally see who is telling the truth.
