Dish Faces April 30 Deadline In TiVo Case

The 522 and 625 are the only 2 models that really are going to be an issue. 721, 921 and 942 models have been recalled and replaced with VIP series product.

There are a few 501, 508 and 510 receivers out in the field still, but its been a while since I ran accross one.

Like I said all along, Dish will either buy Tivo or pay the licensing. If Dish has to pay the licensing, there will be a slow migration to an all VIP platform!


The only sad part for me is when my 625 becomes obsolete either by Tivo or completion of the Western Arc so goes my 2-120 minute live buffers!.:(

Relax and enjoy your television and when and if DISH is forced to shut off their DVR's then worry about it, it does no good to just moan about it now.

From where I sit the DVR's you have now will work today and will still be working long after April 30th. Life is too short to worry about "what ifs" especially when it seems to be some peoples jobs to just come in here and start trying to scare folks.

Yea I notice the same thing going on over at that other place.Like Tivo posting a big loss and being put on deathwatch by several sites doesn't have anything to do with that.:rolleyes:

Think Tivo stockholders are upset Dish stockholders got a $2.dividend?.;)
 
TIVO has been on shakey grounds for years now, and I don't believe has ever made a profit. So they have been on the deathwatch for awhile now.

Personally I hope TIVO survives.
 
There is another "what if" that no one has discussed. E* has proposed two new "work arounds" for the Court to consider. Judge Folsom seems to be saying he doesn't have the time or inclination to review them. Now remember, it was Judge Folsom that ordered E* to submit any new "work arounds" to his court before implementation. What would prevent E* from implementing one of the "work arounds" after giving Folsom a reasonable amount of time for review? Judge Folsom can't have it both ways. Right now he has put E* on the clock while delaying a review of E*'s "work arounds". If E* has met his demands in good faith, a review of the "work arounds" should be given prior to any deadlines. However, Judge Folsom has stated that he wants E*'s infringing DVR's shut down no matter what. Perhaps a bit of bias is showing in his recent decisions.

That isn't the way the injunction reads. Judge Folsom's approval is required, not just submittal. He is under no obligation to do anything though. He may require Dish to first file and win a declaratory lawsuit proving they no longer infringe before entertaining an approval request.
 
Hey could also dress up like superman complete with blue tights and dance out in the rain singing like Danny Kaye. He is the judge and can do what he wants for the most part. :)

So what your point besides trying to spread more fud?

Didn't E* do just that in Delaware? Wasn't that case transferred to Judge Folsom, the alleged expert in DVR infringement cases?

Hey...:confused:...:D - personally, I've grown tired of this entire matter...E* needs to open their wallet (through license or purchase) and be done with Tivo.

It is FURTHER ORDERED that Defendants shall inform this Court of any further attempt
to design around the ’389 Patent and shall seek approval from this Court before any such design- around is implemented.
E* has complied with this part of the injunction. E* has sought court approval for a new work around. It does not expressly prohibit E* from using the work around if the court does not act (or just stalls in this case).

As a company, I don't think Tivo will survive unless Congress and the FCC enable and enforce meaningful cable legislation reform - to include the Satellite Industry. The Telecommunications Act of 1996 did little to break the cable cartel of their set-top-box monopoly since almost 93% of STBs implemented are owned by the cable cartel (Motorola/Cisco). Cablecard has a dismal failure and, based on my recently interaction with Comcast, only 1 in 6 people in tech support know how to properly provision and activate a cablecard placed in a consumer device (Tivo, TV, etc.).

Hopefully the National Broadband Plan will require that MSOs---both Cable and Satellite---install a gateway device based on open-standards in the customer's home so CE manufacturers, like Sony, Samsung and LG, can make fully functional set-top-boxes. Given the history of the VHS, CD and DVR (even Blu-Ray for that matter), there is no reason why we shouldn't be able to buy a HD DVR at the local Best Buy for under $200 (to include Program Guide Data) and have our cable and DBS providers activate these devices. The Tivo brand may survive, but the company cannot survive given the existing market...and they probably won't survive when the likes of Sony and Samsung get involved. Unfortunately, Tivo's future implosion does nothing to help E* at this time.
 
The FCC did set a deadline for all cable companies to support open access to 2 way communications by 12/31/2012. Essentially there can no longer be proprietary boxes after that date.

I just looked on ebay at the prices one guy has and it's not cheap I see. Maybe letting them just replace it if it comes to it is my best bet.....cept for that I am 'moved' issue :/
