You would have better luck filing a class action against E* for not providing any HD in their DishHD (more appropriately known as DishHD-Lite) product...
According to VOOM, it was EchoStar who illegally terminated the affiliation agreement...the reason VOOM is not on Dish Network is because EchoStar was unhappy with the terms of the agreement, they violated sections of the agreement by moving the VOOM HD channels into a higher tier, and E* then proceeded to break the contract when leadership at VOOM did not succumb threats and agreeing to be re-tiered according the EchoStars wishes.
Again, it was EchoStar who terminated the affiliation agreement and thus removed VOOM from their DishHD-Lite lineup...this is a known fact which cannot be disputed (read the press releases and court transcripts!). Everything else, to include who violated the agreement, is disputed and is a matter for the courts to decide.

When its in the E* forums I read it. When its another sue Happy person, I read it. Right away lets Sue them! Over channels that were dropped! That is Pathetic!:tux: Unless something harmed your family and friends in some way, Lets put the sue card away!
This is silly because VOOM will not be around by years end if Voom can not wrok out a new contract with DISH. Only one cable system has VOOM and they may drop Voom in the near future. Voom needs Dish. My guess is that in one month Voom will be back on Dish with a different lineup.
Wonder how much crying, and for how long the crying continued if what was dropped was the RSNs, or the NBC Universal channels...its just TV, afterall...
Most of us understand your frustrations regarding the loss of Voom. Simple reality, Dish can do whatever, whenever pertaining to programming. I do not see class action litigation as an option in this particular circumstance.
With that said, you do have the right, due to the 'intentional' downgrading of the service by Dish, under which you originally contracted, to request termination/renegotiation of your contract, negotiate a non binding contract pertaining to time constraints, downgrade, cancel services, etc. I urge you to exercise these rights.
Furthermore, if you remain with Dish, you do not have to accept a downgrade fee of $5.00 since they initiated the downgrade in services, if you opt for a different service package (i.e., HD Only)

There would be a lot . That would Effect Every provider, Not just 1. That wouldn't happen ,Because RSN's have a much bigger fan base then VOOM. YESHD has a Bigger fan base then all 15 Voom channels put together. I'm not doubting your loss ,But they aren't coming back anytime soon. Thats That. Sue all you want!
By the time any litigation would see the inside of a court room, your contract will have expired and Dish will have lost another subscriber. In the meantime, as FCOM said, drop services to lower your bill to the lowest level you can without breaking your contract.
Voom will be most likely be dead within a month if they don't renew their contract with the few cable companies still carrying them.

true enough. But in the past whenever these thing shave happened the whole issue of law suits has arisen pretty regularly and those not directly affected have always told others that while we night sympathize that we really did nots eea course of action given the nature of the contract between DISH and its residential subs.
Nobody forced you to spend $2,000 on a TV, and nobody forced you to agree to a 2 year commitment. A 2 year commitment was offered in exchange for a discount, and you agreed. You didn't have to do it. You'll have absolutely no luck in court due to Dish's terms of service that you agreed to. Switch to DishHD Essential and save yourself $10/month. You'll get the $150 you spent on the upgrade back before your commitment is over if you do that.
Near as I can tell there is only one other US provider carrying them----Cablevision. Does any other US carrier offer VOOM.
BTW they are on one of the Canadian systems and they are distributed abroad. Not sure that there is much revenue to those deals but they do exist.
Dish and voom need to end this asap. People are hurt by this. Subs invested money no matter how you look at it.
There are people who take great joy in seeing true HD programming disolved. I think in the end we all suffer.

I understand that you are upset. As I have mentioned a number of times I watched VOOM as well. All I have said in this thread is that I don't see much likelihood of success for a class action suit against DISH because of the terms in the residential agreement.
the fact that you and I both wish that it had not happened does not alter that. I was upset when DISH had a dispute with my local ABC affiliate, I was uset that it took them so long to come to terms with my local RSN, and I was uspet that I can no longer sub to MLB EI.
but the fact that I am upset does not mean that i would prevail in a lawsuit.---which is what I thought this thread was about.

Only those with Cable Cards can not see switched video. Cable Card take rates are generally very low. Sending the less in-demand channels only when someone tunes to it. Frees up/lets them juggle bandwidth better.
What Discount? What Special Deal?
People keep saying I only signed a 2 year contract for a special deal. There was no special deal. Having to pay $150 to upgrade my service and get an HDDVR is a special deal/discount? Do you guys work for Dish Network or something?
I have a legitimate argument/concern. If you are a Dish Network customer, how can you not have some anger/resentment towards the company if they switch their HD programming with NON HD, upconverted, stretched, commerical ridden content.
Either I'm insane or people would prefer to watch a movie like Casino on Bravo for 4 hours with 1 1/2 hours of commercials, vs. commercial free 720p/1080i HD films on Monsters HD/Rave/Kung Fu/Gallery.
My other argument is this: If you live in an apartment, and the landlord has a dispute with the water company and doesn't pay the bill, the tenant is left to suffer when the water gets turned off.
Dish network has a dispute with Voom, so they decide to terminate their contract. In the apartment situation, a tenant has the legal right to sue the landlord for loss of services. Why shouldn't that apply in this situation?
