Class Action Lawsuit against Dish for Dropping Voom?

to be fair this agreement applies to DHA customers only but I suspect that at least some of those involved are subs to that agreement. In any event the only difference between that and the residential agreement seems to be notice.
Dish doesn't call their standard deal "DHA" on their website anymore but I believe if you're under contract, you're under "DHA". So, it does apply to anyone under contract and therefore gives Dish an out. If customers are not under contract they can walk away free and clear if they don't like a change Dish makes.
 
Isn't Dish Network a cable company, which are considered public utilities? I made the argument earlier that if you live in an apartment, and your landlord is in a disagreement with the water company, a public utility, and decides to stop paying the water bill, the water company will shut off the water. All the tenants are now affected. Those tenants have a legal right to sue the landlord. Why should the tenants care what the disagreement is between the landlord and the water company.

I'm guessing that the landlord is required to provide you with running water according to a standard lease that you sign. So, yes, you could sue the landlord.

However, the contract (lease) you signed with Dish Network specifically gives them the right to change the programming as they see fit.

It's all in the fine print, no matter what the situation is.

BTW - I do have Dish Network, I don't work for them, and last I checked I didn't have a hankering for brains, so I must not be a zombie.

I am in no way trying to say that I specifically bought a $2,000 tv because of Dish. I am saying once I had that $2k TV, I wanted to watch the best possible HD available. I did my research and looked at alternatives, and found Dish Network to be the best specifically because I am a huge film and music fan. Their offering of Monsters HD, Kung Fu, Rave, and Gallery were what made me decide to spend an additional $20 a month

PLUS agree to a 2 year contract which I was required to do. I attempted to ask why I had to sign a 2 year contract but was told it was required. Period. End of story.

If you people are quite satisfied with NON HD, BLACK BARS, UP CONVERTED, STRETCHED, COMMERCIAL RIDDLED, PAID PROGRAMMING AFTER MIDNIGHT, mindless garbage, then keep quiet.

No, I'm not. I've complained to DISH. I even complained to HDNet, because DISH's action is going to cost THEM subscribers to HDNet Movies. (And I got an e-mail from Cuban's assistant that said they were "working on it.) Complain all you want. Complain on the forums- that's what they're for. Complain in writing. Complain on the phone. Complain by e-mail. If you're an HD Ultimate customer, DROP THAT TIER! Take a look at Direct and see if it's a viable option.

Just don't complain in court. It's a waste of time and money. Don't put another dollar into the scumbag trial lawyer industry. Don't waste another taxpayer dollar on petty concerns, even to file a paper that's going nowhere. Your attitude is destroying America.
 
Even the DHA agreement posted states that if you accept the offer you are under the residential agreement and it provides a link. But THE DHA offer does show what was offered if you signed up under it.

i was unaware that they stopped using the term DHA. It is still all over the website a I assume that some customers are under DHA and some are not. But I could be wrong and I am often proven to be.
 
I would guess that it became moot after the particular channels were restored. But good catch Cosmo.

All i really remember about that VIACOM matter was being offered a credit. The credit offer predates the suit. But I have no idea how Ms. Dolan's suit was resolved. The firm is a big class action litigatora nd lists the status of amny cases but not that one.

Name three websites, not counting SatelliteGuys, DBSTalk, and AVS Forums, that have any reasonably amount of discussion, i.e. publicity, about the dropping of VOOM.


I've got one for you.
Name just one channel(s) that was removed that generated a reaction similar to what the removing of VOOM generated.

Certainly there are subs that don't care for VOOM but apparently there are a lot who do.

I am not saying there arent subs that really really want Voom back, that is obvious, however MOST of the outcry here (and some other sites) comes from the same few members.

The VIACOM channels. That was a big stink even though very few of us thaought it would last long.

I thought the same thing. Looks like they only list results of cases they "won".

Accordingly, most of the Dish subscribers don't read/post comments in this forum. Most subscribers are probably unaware that this forum exists.

I would think most true HD fans would appreciate that as well..

But I guess Im wrong considering the bashing of voom going on..

Absolutely...I'm one of those few.

And I can't even get very many people to agree with me that the main issue is the now-overpriced HD Ultimate package. Most of the posts are of the "Me like Voom, me mad, me want Voom back" variety. I just don't appreciate being over charged. Voom ran itself into the ground. I'm in the minority of the minority. There's like 3 of us. :D

True, which is why I think it is impossible to really tell if there are that many people that are upset or not. All we can really go on here is what is posted HERE, and again, it seems to be a very vocal minority. Nothing wrong with that, its just what I am seeing
 
Again, it was EchoStar who terminated the affiliation agreement and thus removed VOOM from their DishHD-Lite lineup...this is a known fact which cannot be disputed (read the press releases and court transcripts!). Everything else, to include who violated the agreement, is disputed and is a matter for the courts to decide.

The courts already decided in EchoStar's favor. That is exactly what prompted Charlie to remove the first 10 channels. Voom's "all-or-nothing" response resulted in the removal of the remaining 5. Why is this so hard to comprehend?
