The NFL doesn't have to meet court evidence rules. Per the league rules, they only have to prove that it was "more likely than not". Beyond a reasonable doubt has no bearing in this, only what is in league rules.

If this did go to court though, then the NFL would be able to subpoena phone records as part of discovery. At which point, the burden is still only what's in the rule "more probable than not".

Brady would be better off to just take the 4 weeks vacation and let this just go away.

Imo EVERY QB does this, Brady got caught. If he would of just admitted to what he did I can guarantee that he wouldn't of been suspended from the Superbowl and his punishment wouldn't of been so severe. All you Patriot fan boys keep telling yourself that he didn't do anything wrong so you can feel better.

He wouldn't have had to admit to any wrongdoing. Something like this is all he had to say:

"It's well known I like the footballs on the lower end of the allowed limits. While also taking game conditions into account, if a mistake was made in the preparation of some of the game balls, I apologize for that mistake and take full responsibility for it."

Maybe a fine, but most likely not even that would have come from this....

Instead of an injunction the NFL and NFLPA have agreed to an expedited schedule to resolve it prior to the start of the season.

No discovery, just two rounds of briefs and responses over the next two weeks.

NFLPA willing to do this because failing to get an injunction probably makes the rest irrelevant if Brady missed games while waiting on litigation to play out.

Judge still needs to approve this plan and make the time.

Judge's Berman's order:

8/12: settlement conference with Judge Magistrate James Franchise. It's been suggested this would be public, reporters able to attend, etc.

8/19: Status/settlement/oral argument w/ Judge Berman. If no settlement it becomes an oral argument.

Brady and Goodell have to attend both sessions.

Limited the motions to vacate/confirm to 15 pages double spaced (lol?) and no reply. The current motions are 5 (NFL) and 54 (NFLPA).
