Analyst: Dish could lose billions

Is patent law different ? I thought "innocent until proven guilty" was the rule, i.e. Dish doesn't have to do anything... TiVo has to prove that Dish is guilty; Dish doesn't have to prove their innocence.
The court order was for Dish Network to turn off DVR functionallity...merely stating they changed a few lines of code and saying the DVRs no longer infringe TiVo's patents is in violation of the plain text lauguage contained in the order. E* has already been proven guilty, so the burdon is on them to prove they and their DVRs are not in contempt.
