The Commission’s open access rule is clear that C Block licensees “shall not deny, limit, or restrict the ability of their customers to use the devices and applications of their choice….” The rule thus plainly proscribes a C Block licensee from selling handsets to customers that hinder a customer’s ability to use applications of their choice...

Again, an issue of interpretation. But those lawyers-interpreters won't come cheap...:)

After reading the article, I can see both interpretations. The solution is also pretty straight forward. "Jailbreaking" will become a legitimate alternate OS to the iOS from Apple. Or, Apple will need to simply obsolete jailbreaking and open the iphone restriction themselves. I didn't see anything in the opinions that said Apple will be forced to warranty other non-Apple sanctioned Apps. Plus all this assumes that the independent app does not harm the device or network.

So, what if the user wants an Apple iPhone and its sandboxed Apps? Verizon isn't prohibiting the user from downloading non-approved Apps, it's Apple. Apple isn't the C Block licensee, it's Verizon/Sprint/T-Mobile/AT&T.
 
The answer is highly dependent on the number of lawyers arguing each side of this...:)

And we both know Apple has a bunch of lawyers that live to argue their case over these types of details.

We know this just as good as Apple being not an exception.
Especially when talking policy issues (jailbreak?)...
