There was no comparison between the NY and LA E* distants and All Americans off air antenna fuzzy picture(when there was a picture-many time the screen was dark). The PQ was beyond horrible. And I wonder how many subs like me(over 8 years at the time) dropped E* like a bad habit over this.

I still say Tektronix had it first. They have a software piece called Time Delay that does the same thing for broadcasters since early 90's. Maybe they never patented it. I know the first time I saw Tivo, I commented about that feature on line.
I agree. Dish will be out of business without the DVR because that is what a lot of new customers are going with now. They will lose so much business it would make their head spin plus I am sure DirecTv and Tivo would come out with an incredible deal to get the Dish Network subscribers with their DVR.
Dish better work on the new software and roll it out instead of waiting until the last minute when a court order gets issued and they lose a lot of subscribers.
TIVO is just trying to get back at someone because they are losing money to the Dish DVR's oh well it is the good old USA.
That is my understanding also. The "complaint" was written at some point in time and if the 622/722 didn't exist, how could they include it ? The fact that they're not mentioned in the complaint and then it's assumed that they use a different algorithm may just be wishful thinking. If they used different code, Dish would have been working on back-porting this for years. If they've invested the time and resources to do this, why not release it NOW vs waiting 'til they're possibly forced to ?
From what I understand The TiVo Patent for Time Warping the Tivo patent is for a software buffering scheme that allows a slow CPU to record one program while the user watches a different one. The 622/722 use the broadcom chip that has DVR functionality built in, so it is not doing the buffering as described in the patent in software.
You are making the rather rash assumption that TiVo will even license E* to use the technology. E* may well have to pay up for the past infringements and cease using it totally immediately.
It all depends on what TiVo wants to do now, they are holding all the cards and chuckie has egg on his face, his bluff was called and he has lost.

It would only make sense. Tivo has been after them on this for quite a while. Dish probably sanitized every scrap of code that even resembled a Tivo patent from the newer receivers. What I wish Dish would do, is strike an agreement with ReplayTV to use their software on Dish receivers. Replay always had the best DVR software. IIRC, they invented the DVR, and Tivo ripped off their patents. I would LOVE to see replay software on Dish hardware.

Well, obviously Tivo didn't. Pot. Kettle. Black. ReplayTV had all these technologies BEFORE Tivo. Tivo infringed on THEIR patents, and has the balls to accuse Dish of doing the same thing.
I turned off the suggestion feature when it started making "suggestive suggestions" after I recorded the classic 1940's detective drama "Naked City".After that, it was recording every soft porn film that was shown. I didn't even realize it until my wife stubbled across them one day. I shall say no more.
Yikes! I don't need that kind of drama in my house! No "suggestions" for me. :yikes
The suggestions feature works fairly well once you get it trained, it learns faster if you rate down things it records that you don't like.
