From CNET- TiVo patent win against EchoStar upheld | Crave : The gadget blog

"A U.S. Appeals Court on Friday denied EchoStar's appeal on an earlier court ruling that said the company's Dish Network digital video recorders violated a patent held by TiVo. The ruling was first reported by Thomas Hawk's Digital Connection blog.
...
Alviso, Calif.-based TiVo first sued EchoStar in 2004 for selling its Dish Network DVR, which, like TiVo's DVR, allows TV watchers to record one channel and watch another simultaneously."

Thanks

Was this a stupid question, or has it already been said?

That wording is kind of vague. The D* DVR "allows TV watchers to record one channel and watch another simultaneously." It doesn't mentioning buffering on the secondary channel - whether that's actually part of the verbiage or not.

I can say that I have sent a couple emails to D* over the last couple years simply suggesting they consider the feature on their new DVRs, and the replies I received did not mention any Tivo patent as being a reason that they can't offer it.
