That was my response to the hypothetical situation laid out in the posting I quoted.

What the contact does and doesn't say is open to speculation. No one here knows. So all this arguing is just us spinning our wheels.

I agree with you 100%,
But the lack of response from dish ( 1 sad sentence), and 3 pharagraphs from Starz, well just by reading what provided clearly points toward Dish in the wrong.
I know many of you feel the same.

I believe Scott when he says (after returning from meeting with Charlie at Team Summit) that Dish was paying for the channels. Most likely, for a brief period, free preview options were exercised to save Dish a few bucks, but I doubt it was against specific provisions of the contract (although there may have been some ambiguity)

I don't care what either of them say at this point. And of course Starz and Disney have more to say; they are the plaintiffs. Fortunately, judges don't simply do a word count to determine the truth, they look at the facts.

But I do know these facts for sure. Disney is mad at Dish, and is in a legal battle that has not been going their way of late. Disney also has a licencing deal with Starz, which is no doubt quite lucrative, as Disney is one of their two big partners for first run films, and is certainly more important that their relationship with Dish. It is pretty easy to put 2 and 2 together there.

Never underestimate the stupidity of judges. The judge in the Disney vs E* case didn't know what a "Most Favored Nation" clause was for. That was until the Appeals Court explained it to him. Disney went back to the same court for this case. Probably hoping for the same judge.
 
Just for note, last May, when I left DirecTV for Comcast they gave me Starz for a year free and they are still doing it for new subs, I do not see Disney suing Comcast.

Disney has a thing for DISH at the moment. I think they expected DISH to cave and pay extra for their HD feeds.

Well then that just proves that Disney is only suing Dish in this case for leverage in their other lawsuits against Dish.

That doesn't have anything to do with the DISH situation. First, Starz and Comcast could have specifically worked out a contractual arrangement that allows for such a promotion. Secondly, we have no transparency into what Starz has in the contract with DISH. Third, Comcast using a free premium as an incentive to get one person to switch is a vastly different beast to a provider giving away the premium channel to all of their subscribers for basically no good reason.
 
Not all subs are getting it. Only those that didn't have premium channel. My brother doesn't get it due to his having Showtime. I had to drop HBO to be able to get Starz for free. I had done it just a while before the give away. I had to contact the DIRT team to be able to get it as it was dropped when I switched programming packs. That wasless than a month before the giveaway so a standard CSR couldn't add it. The pressure from Starz directly due to Disney pressuring them about the "movies" of Disney is on there channel.

You're right about the cause for the pressure. However, you're incorrect about folks with other premiums not getting Starz. I have HBO and Showtime (but no Skinemax) and receive Starz for free as part of the current promotion.

It had to do with dropping NFL network

Apparently, Comcast will be dropping the NFL Network at the end of April 2009, and as compensation for the reduction of service, they are offering customers one year of free Starz or one year of free High Speed Internet speed upgrade. After the one year, the service upgrade will be dropped automatically.

To redeem the offer, call the Comcast Customer Appreciation Offer Hotline at (866) 671-0782 and you will be prompted, "If you recently received a letter concerning possible NFL Network changes and are calling to redeem one of the customer appreciation offers, press 1."

I think the offer is intended for customers who subscribe to the Sports Entertainment Package. I did not receive the letter and do not have the sports package, but I called the hotline and was still able to sign up for one of the offers. (I chose the Starz package; I have no idea what the Internet speed upgrade entails.)

With comcast the deals seem to not be consistent .
Three friends that left dish all in the same week one went to local office, one to retail location ,and one from door to door. three different deals the last the best..the local office refused to match door to door

Screw Mickey Mouse /Disney and their partner Espn. DISH should NEVER pay more for the HD feeds. HD is now the NORM , not the exception. The time for extra fees on hd were a few years back and now are officially OVER. DISH proved that with FREE HD for LIFE.
 
i find it interesting that disney took this long to make a stink about the free starz deal. and also that they started haveing the issue after dish got blockbuster. isnt the free starz for a year similar to cinamax for a penny offer for a year??? but really why would it take disney this long to make a case out of it. the blockbuster deal has to be part of the issue and their hd dispute that caused us to loose disney hd feeds.

So far Disney hasn't been doing too well in court. So w/ that & all the other things they think that they have some leverage. My the mouse get caught in another trap.
