I haven't been taken to the cleaners yet, I paid with payal and it's guaranteed for $200, so I can file a complaint and get my money back. However, I really want to be able to use this receiver. I think the problem lies within dish, their stupidity somewhere. How can they not activate a brand new receiver I purchased?

Please, the posters here are correct. Dish will not, CAN NOT, activate anymore 721's due to a civil court action by Tivo. For Dish to activate a 721 would be in VIOLATION of a court order. Can you now see the picture?
Dish is done with 721's and will only support current 721's that have been in operation since the court order took effect. A few other, older STB's are affected as well.
We are sorry, but someone ripped you off. I hope you are successful in getting your money back and Ebay takes appropriate measures to prevent people from selling what they know is now a worthless product.

Seriously, some of you need to do your research before you go running off on a wild tangent.
...I've bought and SOLD my old receivers on Ebay without a problem -- EVER. You do NOT need to be a retailer to get a good deal or be "safe" in a transaction.
Also, 721s reportedly can be activated as long as they are "in the field" per my interpretation and understanding of the injunction. Now, this may change in a moment's notice, but so far, that's what it appears to be.
Oh and before I forget: 721s are dual tuner MPEG2 SD DVR receivers. And there are plenty for sale on Ebay. And not everybody on that site is trying to pull a fast one.

Major-V, you are coming in here with great authority in all of your 29 posts, and telling those of us that have been following this issues with great interest for years that we are uninformed and trying to mislead the OP.
We have been discussing this for some time. When the court orders came out, we investigated the implications using both front door and back door methods. We were clearly informed that these receivers would be allowed to remain in service as long as they were never deactivated. Transferring accounts involves a de-activation, followed by a new activiation. This was disallowed by specific wording in the court order.
If Dish is allowing this, it is at odds at what we were told WHEN WE ASKED THIS VERY QUESTION to our dish contacts. If Dish is allowing this transfer, they are treading on very thin ice with the courts. Of course, that seems to be par for the course at Dish these days. However we have not seen an example reported where a 722 was transferred to another account since the order was issued.

Actually there is plenty of factual information in the posts about the 721 and the Tivo injuction. If you so sure your correct in your info, please post a reference.
Also, a buyer of a used satellite receiver should always call E* and check if the reciever they want to buy is in the clear. From Ebay or anywhere else. The OP didn't do this, but luckily it seems to have worked out for him.

That still ABSOLUTELY CORRECT information !
I saw a post earlier that stated to the OP the reason he wasn't able to activate it was because it did or did not have MPEG-4 (cause dish is moving to MPEG-4 only in HD).
I think people confuse it with the 722 (just one number makes a big difference).
If it was under his name then it wasn't newOK, who was the big 'know it all' that informed everyone that DISH couldn't activate 721 receivers because of a patent issue? The seller finally got back to me, and come to find out, the receiver was in his name somehow. DISH offered to activate it under my account by his request. Remember the remarks "DISH won't activate new 721" ?? Looks like I wasn't take through the cleaners after all! A little research next time before posting suggestions might help.
Before I deactivated my 721, I inquired as to whether it could be reactivated later because of the Tivo lawsuit. E* engineering, to whom I was transferred, said it could be reactivated and that only never-activated virgin receivers were covered by the agreement.

This is a clarification of the "Notice of Tivo Injunction" that was sent this morning. DVR
models 501, 508, 510, 522, 625, 622, Homezone 622, and 722, have all received the
redesigned software and can continue to be sold, installed and activated. With respect to
those models, no further action is necessary on your part at this time. However, the 721,
921, 942 and Homezone 1022 models did not receive the redesigned software. Because
the injunction goes into effect today, any existing inventory of those models that has not
yet been installed or activated for a customer cannot be installed or activated in the field.
721, 921, 942 and Homezone 1022 models that are already installed and activated are not
subject to the injunction and can continue to be used by customers.

In short, IF a 721 is activated today, it is done so in error, or something about the injunction has changed that we don't know about (doubtful). Or what Laddyboy heard is true, which is a somewhat different interpretation from what we've heard before.
