I was on travel much of last week and missed this one. To my surprise I didn't find it discussed anywhere in the forums. Anyway, to me it appears that Dish Network is practically conceding $328 million to Tivo for violating (comtempt) the court order by not disabling offending DVRs. Perhaps I am reading too much into the reporters brief comment, but this does not sound good for Dish Network.

Instead, EchoStar’s lawyers gave U.S. District Judge David Folsom a figure of $328 million as their high-end figure and called TiVo’s proposed number “absurd” at a hearing Tuesday morning in downtown Texarkana.
Folsom ordered EchoStar to turn off the recording feature in millions of its digital video recorders after a jury found in 2006 the company was making big profits using software in them that infringed on TiVo’s patented “time warp” technology...."
