And the bill is called the “Next Generation Television Marketplace Act" which would do three things:

  • "Repeal those provisions of the Communications Act that mandate the carriage and purchase of certain broadcast signals by cable operators, satellite providers and their customers.
  • "Repeal the Communications Act’s retransmission consent provisions and the Copyright Act’s compulsory license provisions, thereby allowing negotiations for the carriage of broadcast stations to take place in the same deregulated environment as negotiations for carriage of non-broadcast channels such as Discovery, Food Network and AMC.
  • "Repeal ownership limitations imposed on local media operators, allowing businesses to evolve and adapt to today’s dynamic communications market."

Anyone want to translate ?

"Repeal those provisions of the Communications Act that mandate the carriage and purchase of certain broadcast signals by cable operators, satellite providers and their customers."

Looks to me like must carry of local stations will be affected, the 'mandate carriage' part seems to imply that the mandated signal carriage would be repealed... hmm

Is this clear enough?;)

It would end retransmission consent — the rules that require pay TV providers to negotiate deals with local broadcasters to carry their programming. It doesn’t stop there: The proposal also would end restrictions that enable syndicators to sell shows exclusively into different markets. And it would scrap rules that bar cable companies from importing network programming from out-of-market stations when they can’t strike deals with local broadcasters.http://www.trekbbs.com/showthread.php?t=153622

Next Generation Television Marketplace Act - The Trek BBS

Sounds to me like this is the bill we've all been waiting for.

I would be right cool not to be at the mercy of the locals for network programing. I remember the old c band days when I had a package called PrimeTime 24 for my networks. Then the locals got the right to deny the service to me because "It hurts our local advertisers and you will miss important weather information" That is a quote from the denial of a waiver from a local station. I promptly called them and told them that I saw the exact Ford commercials on the PT24 station from Tenn. and the only difference was that it said to visit your local Tennesee Ford Dealer instead of my state. And as for the weather I told them they lied about that 40 percent of the time and The Weather Channel was more accurate than they ever thought about being. I would tell em today the only time I see any of their local news is if I happen to catch it at the tail end of a Judge Judy episode my wife has recorded. Well enough of my ranting I am sure the Broadcasters have more clout up there than sat operators or cable companies but it would be nice to see this happen.

Ahh yes, the Prime Time 24 package, I also had the Denver 5 :D

Really enjoyed them, but like you said, they took it all away .....

The rules that protected local stations are antiquated, anti competitive and have elements of censorship and should have been overturned long ago....(In My Own Opinion).

Side note: I wonder how many members here in this specific forum already receive more than one TV market OTA or 'otherwise' ...if anything to just to show the whole 'one station per network per market' is not only convoluted but impossible to enforce.

I do, Toledo and Detroit OTA.

What I would like to see is, (seeing they are still going to be limited by the Spotbeam for your area) to be able to order any cities locals in your Spotbeam area.

That would be cool !

I would pay the extra $ 5-6 p/m for that choice.

My local areas spotbeam covers a wide area, at least I think so....

Toledo, Detroit, Columbus, Cleveland, Cincy, and Chicago (on the fringe) and I think Indy as well.

I now get Cincinnati and Dayton OTA. When this goes through, NY and LA first then my three local preferences will be Louisville, Lexington and Columbus Ohio and are well within the spotbeams. Cincinnati stations news coverage of Kentucky is not good at all. They don't seem to report anything beyond 20 miles into KY. If I knew Cleveland was within spotbeam I would opt for that too...but think it is like 250 air miles from here...maybe more..

That is IF they are able to open it up that way.

That would be nice, but I'm not counting on that happening, at least not for awhile.

I know I can do it now by 'moving' to Louisville, and then getting that Dish 'welcome pack' with a Lexington address...That would take care of the KY part :-)

Before we all line up on one side or another, here's a reasonably good report on the bill:

http://www.rbr.com/media-news/washi...tion-bill-introduced-in-house-and-senate.html

Here are the guts of it, from RBR...

Specifically, the legislation would:

-Repeal those provisions of the Communications Act that mandate the carriage and purchase of certain broadcast signals by cable operators, satellite providers, and their customers.

-Repeal the Communications Act's "retransmission consent" provisions and the Copyright Act's "compulsory license" provisions, thereby allowing negotiations for the carriage of broadcast stations to take place in the same deregulated environment as negotiations for carriage of non-broadcast channels such as Discovery, Food Network, and AMC.

-Repeal ownership limitations imposed on local media operators, allowing businesses to evolve and adapt to today's dynamic communications market.

<snip>

RBR-TVBR observation: Don’t get too excited. This bill is going absolutely nowhere. It is doubtful either chamber will even hold hearings. But it is interesting to see how far some lawmakers on the far right would like to go with deregulation.

The big deal is that it allows importation of distant network signals into local markets. Given the NAB's clout on Capitol Hill, it's DOA.

Remember, it's just been introduced....and that any member can introduce anything. My prediction...it never gets a committee hearing.

me :)

Minneapolis via OTA and on D*
Mankato via OTA and partially on D*
Duluth via "move" on E*

Minneapolis is my actual DMA..
Use to live in Duluth and Dish carries them in HD, Directv doesnt. So Welcome pack & moved locals on Dish

Mankato is a 3 county DMA about 60 miles from the house. They are CBS & Fox subchannel. I "moved" to North Mankato (which is still technically in the Mpls DMA) but CBS Mankato is Sig viewed (heck their studio is in North Mankato). I'm working with D* to get Fox added. KEYC added it on 7/1/07 but Directv already had Mankato local (KEYC) up (the rest of the nets were from Mpls). They recently (2 months ago) added Fox to the Mankato local package but not as SV yet.

side note...yes KEYC is the station that made Letterman's Top 10 a week or so ago because the news anchor was totally on something when she did the news on the 4th. She was drunk or on something and the video went viral.....the station says she had a bad reaction to meds and was sick...mmm hmmmm

If it wasn't for the fact that my locals are part of my satellite package, I probably wouldn't watch them at all. I am at the fringe of broadcast coverage (one station even sent a truck out to measure signal when I applied for waivers many many years ago). I think the satellite carriers are HELPING the broadcast stations by carrying their "message" into more homes.

I also had the Denver package along with the east coast stations. It was weird seeing John Elway selling cars!

:)

Those were the days ...

I could get ALL my C-Band programming for $5-600 now it's triple that.

I could have got the West coast too, but enjoyed the Denver channels and it served the same purpose.

I had the west coast stations for a short time, too. You are right, those were the days! I still have the dish and a Toshiba receiver, but I haven't used them in years.
