I agree. It's obsolete. The best place for that junk is on cable or satellite TV.
Not everyone has cable, satellite or broadband options.

Of course one could make a case that running a lot of the content currently carried on OTA isn't much in the greater public interest.

In terms of whether or not it is possible, Next Gen features conditional access per A/360. DTV has conditional access support (A/70) but I haven't seen it used.

...Another option for airing those types of programs on broadcast TV, is to air versions of R-rated movies on digital subchannels that are censored for content and profanity with a TV-14 rating.

As for porn or uncut adult movies...that smut just doesn't belong on broadcast TV at all, even if it does get scrambled and requires a special pay-TV descrambler box to pay for it!

That becomes an issue of copyright violation if it isn't sanctioned by the owner of the content.

You could say the same thing about hip-hop, rodeo (as a venue for animal abuse) or anti-American programming. Just because you may not appreciate it doesn't mean that it doesn't have an audience.

As uses for the airwaves merge with (or are replaced by) those of the Internet, who's to say?
