There still may be some confusion as to what your problem is. So let me clarify:
IN SINGLE MODE: If you are tuned to LIVE TV and NOT playing back any recordings, then the two tuners will record to the buffer the programming for a maximum of one-hour. Remember, you have to be tuned to that channel for some length of time for the buffer to accumulate sufficient amount of programming to fast rewind through. If you playback a recording, then ONLY the background tuner will record to the buffer, the foreground tuner ceases recording to the buffer when and during your playing back a previously recorded DVR event. When you dump-out of the playback of the DVR recording, the foreground tuner begins to again record to a clean buffer.
IN DUAL MODE: The tuner will record to the buffer just like in single mode, but only for the tuner you are watching. When you playback a previously recorded DVR event, the tuner you were watching dumps the buffer and will not record to the buffer while you are watching the previously recorded DVR. The tuner will begin recording to the buffer AFTER you have dumped-out of the previously recorded DVR event to live TV. So, in Dual Mode, recording to the buffer is ONLY while you are watching live, and of course you can trick-play, pausing, skip back, skip forward etc.
If it is not recording to the buffer as described above and a reboot did not help, then you need to RMA the box because it is not functioning properly.
