Hello I just signed up for Dish Network. I was told the price package that I picked with a DVR was going to be 42.99 (This included everything). When the guy came to install the new system I was informed he didnt have a work order that included a DVR. He also said the price would be $57.99 then he changed it to 49.99. I was also informed locals would be free with my package which they are not and that I didn't need to install a phone line or for that matter an ethernet cable to my router.

The only reason why I quit Directv was they were expensive for what I got. The picture quality was excellent. Dish has been out to my house 3 times now since the new installation and they will be coming out again on Saturday for the 4th visit to rectify the problem. I have the 722k DVR unit for my room and a non dvr until for the two tv's downstairs (Family Room & Kitchen).

I called to cancel today but was told I have a contract which I never signed. When I called yesterday the Customer Service person said I didn't have a contract. The local Dishnetwork office told me if I didnt sign the White paper that said Digital Home Advantage Promotion Agreement that I do not have a contract with them. I told my parents not to sign anything that said it was a contract until they resolved the pricing issue that they promised me as well as the bad picture.

The only thing my mother signed was something that said: Dish Network Service L.L.C Service agreement. It's a long sheet of paper with carbon copies. Before my mother signed the paperwork she asked the installer if this was a contract. She said she wasn't signing any contract. The installer said it was just a form saying he was there and installed the receivers. Unless the installer lied to the parents about what she was signing. Does anyone no if this is a contract that my mother signed? If this is a contract the installed Lie about what my mother was signing.

The reason why I told my mother not to sign the contract was because I wasn't agreeing to the contract until the pricing was correct on what I was quoted as well as the picture.

Its amazing Dish Network just settled last year on a lawsuit similar to some of the problems that I am having now.

I plan to contact the Indiana Attorney Generals office on this matter as well as the BBB. For now I am waiting 7-10 days to find out from the cancellation department if I have a contract. If they say I have a contract I still plan to fight it. Seeing as my mother asked the installer what the paperwork was before she signed it.

Most of the customer service people I talked to were very rude and refused to do anything to help me.

I would appreciate any help on this.

Directv is a much better service even though its more money. I would rather pay more money than having to deal with people that lie and are deceptive on how they sell dish services.

What you said your mother signed is not the contract, it is basically just saying that they installed the system, that you own or had permission to install at the residence, also warrants the installation for 90 days. You should have gotten a pink copy, it is one page front and back. The contract is two pages, so if you did not sign it then you are free to go if you wish if the system does not work properly.
 
The paper your mom signed is a contract. The part she initialed says you agree to be bound by the terms and conditions of the residential customer agreement and service agreement terms. The part she signed just says you are happy with the work the installer did.

I have been installing for years and that is the paper we have the customers sign for the contract.
 
If they try to hold you to a contract that you did not sign it is very easy to beat them at that, you just have to ask them to produce the note. This would be your first step in court if it gets that far, but if you just say this to them that you want them to produce the note (original copy with your signature) then they will most likely back off since they know they do not have it. If if does get to court small cliams might be the best option since you don't need a lawyer and it can be used for consumer claims probably in most if not all states, and you can actually ask for more than the actual cost for restituition, for instance if they try to charge you an ETF or for the installation. Its different in each state, but here in RI you can seek 10x the damges up to I believe $2,500 in small claims.
 
More than once E* has called the office asking for a copy of the contract to be faxed to them to show the signature. It does not have to be that signed it as long as its someone over 18 that you had be at your house its legit.

That would be illegal if that is what they are doing, since you do not have to sign a contract to get service. If they only signed the LLC and not the DHAPA they have no right to hold you to the contact that has a 2 year term and an ETF. What they can do is charge the costumer the activation fee and for the installation since signing the contract with the 2year commitment is a requirement to receive those services free.
 
Hey Just know what we have them sign and that dish uses it to enforce the 2 year commitment. I personally don't care if its legit or will hold up in court. The OP can try to fight it but since the equipment is activated hes probably stuck. But I am not him so it does not matter to me
 
dude, 57.99 is the regular price for locals, silver200, and your dvr fee under dda. but with your 24 month commit, you get the 15.00 off for a year. so your actual price will be 42.99 for the first year.

the price of 57.99 will show up, then on the bottem part of the bill your 15.00 discount is there. just like when you buy an item at the store with a coupon. they show the regular price, hten at the bottem your coupon discount shows.

Yeah, thats true. The only thing with price that the op can do is that if they did not tell him that he needed to sign a 2yr contract to get the price, thats where the deceptive sale practices come in. Indiana was one of the states that settled, so if you file a compliant with the AG they will already know about it and just reopen it because thats what the case you mentioned was about.
I was more talking about not signing the contract, if they did not sign it they can not hold them to the 2yr term, but also you will not get the special pricing.

As of yesterday they were STILL selling perspective subs the old pricing, knowing full well by the time the first bill comes additional 722s will be 17 bucks a month extra plus 6 buck DVR fee, not waived for AEP subs.I called their sales number on a phone number they didnt have

E sells with smoke and mirrors to RIP OFF CUSTOMERS STUCK IN A CONTRACT!

Congress should pass some laws, locking costs to only minor increase, so people cant get screwed.

I am stopping by congressman jason altmires office I am a campaign volunteer.

It would be great consumer protection legislation:)

I hear this over and over and over and being in the sales process I find this hard to believe. The Dish Network Service L.L.C Service agreement, is the 24 month agreement.

First of all when you setup a new account your verbally told there is a 24 month committment.

Second of all when the installer did the installation, he left with a signed 24 month contract.

Bottom line is that the installers don't get paid for their installation if they don't turn in a signed contract, and just about all installers know better not to leave your home without a signed contract.

There is probably a recording available of the origional sales call, I know I have to record everything at my call center for QA purposes and upload random sales calls every week.

As far as cancelling service, your not going to get anywhere going that route since DISH Network will just go ahead and enforce the contract and not give you any type of compansation. Your best bet is to call customer service, speak to loyalty and see if there is any type of adjustment of credit they can issue to make you happy.

You skipped rule number one.....read before signing..Actually your questions should have been asked and answered at the point of sale. The installer is exactly THAT. An installer. It is beyond his province to negotiate or even diuscuss terms and conditions. All consumers should do their homework before saying yes.
I have a cannned response to all pricing inquiries in which I gladly receommend the customer talk to Dish BEFORE I start work.
I simply call Dish and let the customer have the phone and they can hash it out.
The installer did not "change" any price. He is not authorized to do so. Quite frankly the installer should not have been discussing price with you.
This is a no-no.
BTW, unsigned paperwork means the tech does not get paid. I doubt it if the tech left with that issue unresolved.
There is an option for the customer to decline the 24 month agreement. Again, this should have been disclosed at the point of sale.
The one most irritating aspect of this occupation is dealing with customers who do not perform their due dilligence.

I am refering to this issue in general terms.
As a fellow consumer, I make sure I inform myslef of every detail before I plunk down my money or sign anything.
I also think buyer's remorse regulations should be extended from three to 5 business days.
I think consumers have less time on their hands and should be permitted a longer period to decide if they are going to be happy with their purchase. As it applies to purchases covered by buyers remorse.

Is that form labeled "Dish Network Service Agreement"?
If so that is the form signed by the customer agreeing all work performed was to their satisfaction.
I add notes in the coment area and make sure the customer reads and understands them.
Of course I cover the entire job BEFORE I so much as take a tool off my truck.
There should have been a second form. That one is the "contract" fro services.
This is the form that explains in great detail the terms and conditions of the 24 month committment.
 
LMAO....I spend $100 a month and there is never dick to watch, don't see me bitchin'

I'm there with you on that, 130.00+ p/m and s**t to watch, same crap on HBO loop, Starz loop, hell I watched(while on the computer)Travel or some channel and it was a show about train rides in various parts of the country, it started showing on channels 4-5 years ago and it's still looping
