EchoStar Communications Corporation has issued the following statement regarding recent developments in the Tivo Inc. v. EchoStar Communications Corp. lawsuit:

"We are pleased that the United States Patent and Trademark Office yesterday rejected many of Tivo's patent claims as invalid. That reexamination ruling, together with the favorable decision from the Court of Appeals earlier this month (finding that the Texas court abused its discretion in connection with key trial evidence withheld from the jury), are steps in the right direction as we prepare our response to Tivo's recently filed injunction motion. Similarly, the favorable U.S. Supreme Court decision last week in the Ebay patent injunction case will be considered as part of the long process ahead."

I meant the legal discussion, opinions, decisions (or summary) by the USPTO...i.e: what patents, disqualification factors, etc. The press release tells us nothing...

Thats what im looking for.... It looks like alot of the patenets are also owned by huges net.. Geee.. who owns huges... D*
 
How come no one else picked up on this. The only news I see is echostar saying they are invalid. I did a quick search on the patent website and all I can find is the request to look over the patents.

If true it also doesnt say what patents. it could be patents completely unrelated to the lawsuit. It's also 9am and the main stream media hasnt picked up on this yet :confused:

NEW YORK (Reuters) - Satellite television operator EchoStar Communications Corp. (NasdaqNM:DISH - News) said on Wednesday the U.S. Patent and Trademark Office has rejected many of TiVo Inc.'s (NasdaqNM:TIVO - News) patent claims as invalid.
TiVo won a patent lawsuit against EchoStar in April, when a Texas jury awarded the digital video recorder maker a little more than $73 million for lost profits and reasonable royalties
 
This statement "together with the favorable decision from the Court of Appeals earlier this month (finding that the Texas court abused its discretion in connection with key trial evidence withheld from the jury)" is also the first I have heard of this as well.

yeah but thats just Reuters reporting that Echostar says the USPO invalidated some patents.

Glad to see reporters are doing research and no one is actually contacted the USPO to find out if its true.

"The level of misleading spin that EchoStar is putting out with respect to
our patent case against them is quite extraordinary. We are pleased to
state that the USPTO issued its first Office Action in the reexamination.
The USPTO reexamined all 61 claims set forth in the Barton patent
confirming the validity of most of the claims, including two of the claims
that EchoStar has been found to have willfully infringed. In the Office
Action, the USPTO expressly rejected the invalidity arguments put forward
by EchoStar. While certain of the patent claims were rejected by the
patent office, this should in no way impact the jury verdict. We will now
be given an opportunity with the patent office to discuss our claims which
we believe should result in a reaffirmed and strengthened patent. We will
provide a real understanding of how this process works on our earnings
call after close of market today."
