Settlement Comes One Day After A $5 Million Settlement of State Charges
December 13, 2005

It's turning into a bad week for DirecTV. Yesterday the satellite broadcaster agreed to pay $5 million to settle a 22-state investigation of its marketing practices and today, the Federal Trade Commission fined the company $5.35 million for violating the national do-not-call registry.

It's the agency's biggest fine to date over telemarketing.

Just to be clear it is not "another $5M" the first $5M was an agreed to settlement offer, not a fine (there is a BIG difference).

This one is however a fine, brought about by the "knowledge" that one of their telemarketing contractors was calling people on the FDNC list.

I am 1000% in favor of reporting the facts and having all companies, not just large ones, fly right, but lets try not to exaggerate the actual reporting.

According to the complaint, DirecTV helped one telemarketer, Global Satellite LLC, even though DirecTV knew that the marketer was violating the do-not-call rules.

As part of the case, Communication Concepts LLC of Tennessee agreed to pay $25,000 and North Carolina-based American Communications of the Triad Inc. will pay $50,000.

Much larger judgments were entered against both firms and their top officers, but they were set aside because the firms cannot pay them.

American Communications was the subject of similar action by the North Carolina attorney general's office.
