For those of you that are interested in this sort of thing, I suggest you read the 1st annual report for Echostar. Some interesting things in it. Read the full report and not the cliff note version.

Here's the link to the 12/31/07 Form 10-K/A filing. EchoStar Communications Corporation - Amended Annual Report

· if we are unsuccessful in subsequent appeals in the Tivo case or in defending against claims that our alternate technology infringes Tivo’s patent, we could be prohibited from distributing DVRs or be required to modify or eliminate certain user-friendly DVR features that we currently offer to consumers. The adverse affect on our business could be material. We could also have to pay substantial additional damages.

Again, that's from Dish Network. Although it is in Echostar's there is more interesting items. Check Item 1A near bottom

Thats an old one. A lot has happened since then.

This is May... that was February.

Err, that is the annual report submitted to stock holders for annual meeting in June. It is not an old report. It is the current annual report. There is a difference between quartley and annual reports.

Item 1A

"We currently have substantial unused satellite capacity; our results of operations could be materially adversely affected if we are not able to utilize all of this capacity"

I am not sure why they would be meeting in June over stuff that was publicclly disclosed in February. A lot changes over time. :)

Yes Dish does have a lot of unused satellite space at 105 / 121. (The old SuperDISH slots)

not to belabor the point, Dish does not own satellites, ECHOSTAR does. Don't read Dish Network.
